Stop Others' Registration and Use of Domain Names Similar to Your Trademarks.
In today's global economy, the ability to register and protect domain names similar to your trademarks is a critical component of any business' brand identity protection strategy.
Filing a Domain Name Dispute
If someone registers a domain name that is confusingly similar to one of your trademarks, business names, or brands then you may be entitled to have the domain name transferred to you.
Even if your trademark has yet to be registered with the U.S. Patent and Trademark Office we can still maintain a Domain Name Dispute.
To prevail in a domain name dispute, we must be able to establish that the other person:
- Registered a Domain Name that is
- Confusingly Similar to Your Existing Trademark, Business Name, or Brand and
- Did so in Bad Faith.
Domain name disputes are typically far less expensive than court proceedings and can usually be completed, from start to finish, in just a few weeks. The typical domain name dispute proceeds as follows:
Step 1: Complaint Filed with the Arbitration Forum. Matter Commenced and Other Party given Twenty (20) Days to Respond to the Complaint.
Step 2: Response Filed. If no response filed by the Other Party the Arbitration Forum will decide the Case on the Complaint alone.
Step 3: Additional Submissions Filed. If after a Response is filed either party wishes to respond to the other's arguments they may file an additional submission in support of their case.
Step 4: Decision Issued by Arbitration Forum. Depending upon the number of additional submissions a decision is typically issued within Fifty (50) to Seventy (70) days of the Complaint being filed.
Step 5: Domain Name Transferred to Your Ownership, if victorious, within days of the Decision Being Issued by the Arbitration Forum.
